These Terms of Use (“Terms”) govern your use of www.torque10x.com and torque10x.com (the “Brochure Site”) and, when live, leads.torque10x.com (the “Portal”), operated by Torque Management, LLC (“Torque,” “we,” “us,” or “our”). By using these sites, you agree to these Terms. If you do not agree, do not use them.
Our Privacy Policy is part of how we operate these sites. These Terms control if there is a conflict about use of the sites. Replacement eligibility for marketplace leads and live transfers is described in our Lead & Live Transfer Replacement Policy.

Brochure Site. General information about Torque and a way to contact us or request marketplace access. Content is general information, not a promise of lead volume, live-transfer volume, quality, price, or results.
Portal. When live, a separate host for Lead Marketplace access (Phase 1 may be “Request access” only; later may include login, purchasing, or call routing tools). Portal product terms, pricing, and buyer agreements — if any — live in a separate writing or in-product terms. Until that writing, a Request access submission is not a contract to sell leads or live transfers.
These sites are for businesses. They are not consumer insurance advice and not an offer of insurance.
No guarantees
We do not guarantee lead volume, live-transfer volume, conversion, return on investment, or exclusive inventory unless a separate signed agreement says so. Website copy and examples are illustrative only.
Accounts (when available)
If we offer login accounts on the Portal, you must provide accurate information, keep credentials confidential, and use the account only for lawful business purposes. You are responsible for activity under your account. We may suspend or end access for misuse, nonpayment, or risk to the service or other buyers.
Acceptable use
You may not misuse the sites, attempt to break security, scrape in a way that harms the service, upload malware, or use the sites for unlawful purposes. You may not reverse-engineer marketplace tooling beyond what the law allows.
Third-party tools
Schedule and contact forms may be provided by scheduling or contact-form vendors and may open in their windows. Their terms and privacy notices also apply to what you submit there.
Intellectual property
Site content, branding, and layout belong to Torque or its licensors. You may not copy or reuse them for competing services without written permission.
Disclaimers
THE SITES ARE PROVIDED “AS IS.” TO THE FULLEST EXTENT ALLOWED BY LAW, TORQUE DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the sites will be uninterrupted or error-free.
Limitation of liability
TO THE FULLEST EXTENT ALLOWED BY LAW, TORQUE IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM USE OF THE SITES. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SITES IS LIMITED TO THE GREATER OF (A) FEES YOU PAID TO TORQUE FOR THE SERVICE GIVING RISE TO THE CLAIM IN THE THREE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100), EXCEPT WHERE THE LAW DOES NOT ALLOW THAT LIMIT.
Separate buyer or services agreements control when they exist and conflict with this paragraph about paid marketplace services.
Indemnity
You will defend and indemnify Torque against claims arising from your misuse of the sites, your content, or your breach of these Terms, to the extent allowed by law.
Governing law
These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules. Courts in Utah have exclusive jurisdiction, except where the law requires otherwise.
Changes
We may update these Terms by posting a new version and changing the effective date. Continued use after a change means you accept the new Terms.
